Rivata — Terms of Service

Article 1 (Service)

The Program is assistant software that provides AI-based conversation, speech recognition, analysis of photos you upload, and related features.

Article 2 (Processing and transfer of data)

1. To generate answers, your conversation text and documents you ask to analyze are transferred to and processed by external AI services (OpenAI, Google, Anthropic, etc.), not by the Provider's servers.
2. Voice is converted to text on your device; the voice itself is not transferred.
3. Photos you upload for analysis (IMAGE attachment) are transferred to and processed by external AI servers to generate answers. The Program never takes or transfers photos with the camera automatically.
4. Data transferred to external AI servers is handled under the policies of those service providers.

Article 3 (User responsibilities)

1. You are responsible for all information you enter or transfer.
2. You must not infringe others' personal data or copyright, or use the Program for illegal or inappropriate purposes.

Article 4 (Disclaimer and limitation of liability)

1. The Program and the answers and information generated by AI are provided "AS IS" without any guarantee of accuracy or completeness.
2. The Provider is not liable for errors or inaccuracies in AI answers, nor for damages arising from decisions or actions you take based on them.
3. To the maximum extent permitted by law, the Provider is not liable for direct or indirect damages arising from use of the Program, including data loss or leakage and device damage.
4. The Provider is not liable for errors, interruptions or policy changes of third-party services such as external AI servers and skills.

Article 5 (Third-party services and fees)

1. AI models and skill engines are subject to the terms and policies of their respective providers (OpenAI, Google, Anthropic, etc.), which you must comply with.
2. AI usage fees and policies are set by the AI service provider, not by the Provider of the Program. Some providers offer a certain amount of use for free; use beyond that may be charged to you.

Article 6 (AI character creation)

1. AI character creation works by transferring a photo, name, background and personality settings to the Provider's server to request (order) creation, and then downloading the finished character.
2. The transferred photo, order details and processing history (received, generated, delivered times, etc.) are kept on the Provider's server to provide the service, confirm orders and answer inquiries.
3. You are responsible for the generated results. You must not create a real person's face or likeness without permission, nor create, use or distribute characters that infringe others' portrait rights, copyright or personal rights.
4. You bear all responsibility for misinformation, defamation, illegal content or similar produced with generated characters.

Article 7 (Scheduling and automatic execution)

1. The Program may automatically run schedules (events, tasks) you set at the specified time.
2. Schedule contents may be transferred to AI servers during execution; you are responsible for the results (sending mail, notifications, etc.) and their consequences.
3. Execution may be delayed or skipped depending on device, network or power state; the Provider does not guarantee execution.

Article 8 (Memory storage and sync)

1. The Program stores information about you learned during conversation (name, preferences, schedule, etc.) and each character's conversation history on your device and uses it in conversation.
2. So that you can use several devices (phone and PC) with the same account, this memory, character settings, alarms and AI keys are stored and synchronized per account in the Provider's server storage. Sensitive data such as AI keys is stored encrypted, and the Provider does not view it except for operation and troubleshooting.
3. When generating answers, memory content may be transferred to AI servers (the AI provider you registered, or the Provider's trial server).
4. You can view, add and delete memories in the app; deleting your account also deletes the data in the server storage.
5. You are responsible for the accuracy and management of stored information.

Article 9 (Program cost and paid content)

1. The basic features of the Program ("Rivata") and the free characters are provided free of charge.
2. Paid characters and custom character creation passes are purchased through in-app purchase (Google Play / App Store); prices are shown on the purchase screen. Because of the nature of digital content, refunds after delivery has started follow each store's refund policy.
3. Third-party costs such as AI usage fees are borne by you under Article 5.

Article 10 (Intellectual property)

1. Intellectual property in the Program's software, design and trademarks belongs to the Provider; unauthorized copying, distribution, modification and reverse engineering are prohibited.
2. Rights and responsibilities for results you create with the Program belong to you (whether AI-generated works are protected by copyright depends on the law of each country).
3. You are responsible for securing copyright and usage rights for materials you enter or upload.

Article 11 (Retention of consent records)

Basic information about your consent — time, terms version, device and connection information — is kept to confirm that consent was given and is not used for any other purpose. The terms in force at the time of consent can be viewed at any time.

Article 12 (Consent)

Installing, running or using the Program constitutes agreement to these Terms. If you do not agree, the Program closes.
